’ورثاء کے معاملے پر حکام سے جواب طلب‘

مقدمے کی آئندہ سماعت اٹھائیس مارچ کو ہوگی
لاہور ہائی کورٹ نے امریکی اہلکار ریمنڈ ڈیوس کی فائرنگ سے ہلاک ہونے والے دو پاکستانی شہریوں کے ورثاء کے مبینہ طور پر لاپتہ ہونے کے معاملے پر سیکرٹری داخلہ پنجاب سے تفصیلی جواب طلب کر لیا ہے۔
ہائی کورٹ کے سینئر جج جسٹس چودھری افتخار حسین نے سیکرٹری داخلہ کو ہدایت کی کہ وہ بتائیں کہ مقتولین کے ورثاء کہاں ہیں۔
جسٹس چودھری افتخار حسین یہ حکم مقامی وکیل ملک منصف اعوان کی درخواست پر کارروائی کے بعد دیا۔
درخواست میں یہ کہاگیا کہ امریکی اہلکار ریمنڈ ڈیوس کی رہائی کے بعد مقتولین فیضان اور فہیم کے ورثا غائب ہیں ان کو بازیاب کرایا جائے۔
سولہ مارچ کو امریکی اہلکار کی رہائی عمل میں آئی تھی
لاہور سے نامہ نگار عبادالحق کا کہنا ہے کہ لاہور پولیس کے سربراہ یعنی سی سی پی او اسلم ترین نے عدالت میں پیش ہو کر اپنا تحریری جواب پیش کیا جس میں عدالت کو بتایا گیا کہ فیضان اور فہیم کے ورثاء کے گھروں پر تالے پڑے ہیں اور ان کے پڑوسی یہ بتانے سے گریز کر رہے ہیں کہ وہ لوگ کہاں چلے گئے ہیں۔
جسٹس چودھری افتخار حسین چودھری نے سی سی پی او اسلم ترین کے تحریری جواب کو نامکمل قرار دیا۔
سی سی پی او کے تحریری جواب پر درخواست گزار وکیل منصف اعوان نے کہا کہ پولیس حکام نے یہ جاننے کی کوشش ہی نہیں کی کہ مقتولین کے ورثا کہاں ہیں۔
سماعت کے دوران پنجاب حکومت کے وکیل ولی محمد خان نے کہا کہ مقتولین کے ورثا دیت کی وصولی کے بعد جہاں چاہیں جا سکتے ہیں اور درخواست گزار وکیل کو یہ درخواست دائر کرنے کا کوئی استحقاق نہیں ہے کیونکہ وہ متاثرہ فریق نہیں ہیں۔
عدالت نے حکومتی وکیل کے موقف کو مسترد کر دیا اور کہا کہ درخواست گزار مقتولین کے ورثاء کی طرف سے مقدمہ کی پیروی کر چکے ہیں۔
سی سی پی او کے تحریری جواب پر درخواست گزار وکیل منصف اعوان نے کہا کہ پولیس حکام نے یہ جاننے کی کوشش ہی نہیں کی کہ مقتولین کے ورثا کہاں ہیں۔
انہوں نے کہا کہ اس جواب سے یہ معلوم نہیں ہوتا کہ فیضان اور فہیم کے گھر والے کہاں ہیں اور کس حال میں ہیں۔
لاہور ہائی کورٹ کے جسٹس چودھری افتخار حسین نے ہدایت کی کہ سیکرٹری داخلہ چار روز میں درخواست کے بارے میں اپنا جواب دیں جبکہ درخواست پر آئندہ سماعت اٹھائیس مارچ کو ہوگی۔
درخواست میں یہ کہا گیا کہ امریکی اہلکار ریمنڈ ڈیوس کو مقتولین کے ورثاء نے بیس کروڑ روپے کی دیت کے تحت معاف کر دیا ہے جس کے بعد سولہ مارچ کو امریکی اہلکار کی رہائی عمل میں آئی ہے جبکہ مقتولین کے ورثاء پندرہ مارچ سے غائب ہیں اور ان کے گھروں پر تالے پڑے ہیں جبکہ ان کے پڑوسیوں کو یہ نہیں معلوم کہ یہ لوگ کہاں چلے گئے ہیں۔
درخواست گزار وکیل نے استدعا کی ہے کہ ان ورثاء کو عدالت میں پیش کیا جائے یا پھر ان کے بارے میں عدالت کو بتایا جائے یہ لوگ اب کہاں ہیں۔

Court extends Kazmi�s physical remand




ISLAMABAD: Sessions Judge Muhammad Aslam Gondal on Monday extended the five-day physical remand of former federal minister for religious affairs Hamid Saeed Kazmi in the Hajj corruption scandal and handed him over to the Federal Investigation Agency (FIA).

The FIA had arrested Kazmi on March 15 from the courtroom when Special Judge (Central) Sohail Nasir had rejected his bail. On Monday, the FIA produced Kazmi in the court and informed the judge that up till now it had been proved that the minister was the main accused in the scandal and he had instructed former Hajj director general, Rao Shakeel Ahmed, to hire costly buildings for pilgrims.
Wajid Gillani, counsel for Kazmi, told the court that his client was willing to cooperate with the FIA and the allegations against him were baseless. Gillani also filed two applications in the court, out of which one had been approved and the other was disposed off.
In the first application he said Kazmi had a backbone problem and requested the court to allow a medical check up of the minister as soon as possible. In the second application, Gillani requested that Kazmi be allowed to visit President Asif Ali Zardari�s father in the PIMS but the court rejected this request.
Talking to media, Kazmi said that the FIA had failed to produce any evidence against him and he was willing to fully cooperate with the agency now and would also do so in the future. He said the FIA along with some elements was deliberately trying to involve him in the scandal.
Separately on Monday, during the hearing of Kazmi�s case more than a 100 people protested in his favour and said that all cases against the minister were false.

Subject: Is Pakistan at war with US?

Dear
The United States of America has violated our territorial sovereignty severely by the drone attacks. We as parliament had committed to not allow such drone attacks from occurring in the 14 point resolution signed by all of us some time back. Despite such a resolve, your government has failed to protect the people of Pakistan from such attacks thereby violating Article 9 of the Constitution of Pakistan: “No person shall be deprived of life or liberty, save in accordance with law” and also violating the joint parliament Resolution.
It is high time that we as parliament must take a decision on whether due to these attacks the USA has in fact declared war on us and if we are technically and legally at war with them. To guide you on this front may I remind you of UN Article 2(4): “All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations. “
In case you have given approval to the USA of attacking our territory through drones without parliament’s approval let me remind you that this is an unconstitutional act liable for severe repercussions. In case you are hiding behind an alleged approval given by the previous government that approval (if existent) and your current continuation of that policy is equally condemnable.
Furthermore, it is your responsibility to inform the UN of such attacks officially so that it may take notice and action through its Resolution and other means. I quote UN Article 51 on Self-defense: “Nothing in the present Charter shall impair the inherent right of individual or collective self-defense if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defense shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.”
I believe it is also your responsibility to initiate a resolution in parliament accepting that we are in a state of war with the USA. Thereby giving our armed forces the approval for a counter attack. May I remind you of Article 245 (1) of our Constitution: “The Armed Forces shall, under the directions of the Federal Government, defend Pakistan against external aggression or threat of war, and, subject to law, act in aid of civil power when called upon to do so.”
The Resolution could be drafted as such: “We the members of the Majlis e Shoora take strict notice of the drone attacks of the USA on our territory which we take to be a tacit declaration of war against Pakistan. Under such circumstances, we authorize our armed forces to take action against such attacks and protect the territorial integrity of Pakistan.”
Such a resolution must be supported during the speech of the President in the upcoming Presidential address to parliament; thereby indicating the President’s willingness to protect Pakistan’s territorial integrity in his capacity as Commander in Chief of the armed forces. Furtehrmore, a special session of parliament may be called immediately afterwards to execute the same intent of parliament thereby giving the Executive the moral authority to attack the US interests in self defence. You may wish to consult with political party leaders on the same.
Anything short of the above course of action and resolution in parliament would be taken as a sign of ultimate weakness on the part of your government at protecting Pakistan’s territorial integrity. And would simply be understood as paying lip service to our defence.
I can only hope that you will take the lead in this crucial initiative. Our economic dependence on the USA needs to be reduced drastically since we are fast becoming their satellite state. Cutting corruption, bringing back the looted wealth of Pakistan and fixing our economy through austerity and self sufficiency is the only way forward.
I hope you will take the right decision.
